Terms of Use

These Terms of Use apply to your access to and use of the timeblend app. Please read them carefully before installing or using the App.

1. General

The online application and all materials made available via the Timetravelr. app, the timeblend app or the Timetravelr. website or the timeblend website (including any Updates thereof (as defined below)); (the App) are made available by Timetravelr. B.V., a private company with limited liability, incorporated and existing under Dutch law, having its registered office and its office address at Kanaalweg 140, 2321 JV Leiden, the Netherlands and registered with the trade register of the Dutch chamber of commerce under number 98782649, (Timetravelr., us, we or our).

The App is an online application that brings history to life in the moment and on location. Use of the App is subject to these terms of use (Terms of Use). By downloading, installing or using the App, you agree to be bound by these Terms of Use. These Terms of Use include a reference to our privacy policy that provides information on the processing of your personal data.

Please carefully read these Terms of Use before installing the App on your device and/or accessing or using the App via a device owned or controlled by you. If you do not agree to these Terms of Use, do not access or use the App and delete it from your device. If you breach any of these Terms of Use, your permission to access and use the App and all rights granted to you in these Terms of Use will automatically terminate.

Timetravelr. reserves the right to change, modify and/or replace all or part of the App and these Terms of Use at any time. When these Terms of Use have been changed, you will be notified thereof when accessing the App.

You may not assign or delegate all or any of your rights or obligations under these Terms of Use. Timetravelr. may assign or otherwise delegate all or any of its rights or obligations under these Terms of Use to any person or entity.

2. Account details

After installing the App on your device and in order to use the App, Timetravelr. registers the number of the device on which you have downloaded and installed the App (Device-ID). Timetravelr. does not have access to your personal data unless you create a user account with your e-mail address and a password (Account Details) or you have knowingly shared personal data with us. The Account Details are personal and confidential, and you may not share Account Details with any person or third party. When you create an account, the Device-ID will be registered with your user account. A maximum of three (3) devices may be registered to a user account.

You are responsible for taking reasonable measures to prevent unauthorised use of your Account Details and you shall immediately notify us if you become aware of any unauthorised use of the Account Details or any other breach of the security measures relating to the App.

If Timetravelr. detects or reasonably suspects that third parties are using or may use your Account Details or if you notify Timetravelr. of such use, Timetravelr. will immediately block access to the App through the relevant Account Details. Timetravelr. will notify you by email as soon as possible thereafter of the unauthorised use and blocking of the Account Details. After blocking, you have to reset your user account with a new password.

3. Access to and use of the App

Subject to the terms and conditions of these Terms of Use, Timetravelr. grants you a limited, non-exclusive and non-transferable right to use the App for your own use on a device owned or otherwise controlled by you in accordance with these Terms of Use and solely for the purpose of navigating, viewing and experiencing routes and content, or retrieving information about scanned objects.

The App is intended for personal use and for general informational purposes only. You will not use the App for commercial purposes or any other purposes nor will you allow third parties on your behalf to use the App for commercial purposes or any other purposes.

You are not entitled to transfer, assign, sub-licence, grant (limited) rights to, sell, rent, lend, disclose, or otherwise make available to a third party, use for the benefit of a third party and/or give a third party the opportunity to use the App, the rights of use relating to the App or any Account Details allowing access to the App.

You are furthermore not allowed to change or remove any indication concerning copyrights, trademarks, trade names or other rights of (intellectual) property or any indication concerning the confidential nature of the App or any reference to Timetravelr.

Timetravelr. is permitted to implement technical measures to protect the App or for agreed restrictions on the duration or scope of the right of use. You may not remove or circumvent the technical measures implemented by Timetravelr. in the App.

Timetravelr. reserves the right to change, modify, add or remove parts of the App at any time and in its sole discretion.

Timetravelr. may send you messages via notifications within the App.

4. Responsibility when using the App

You shall not use or permit others to use the App (a) to send, receive or post any material which is offensive, of an indecent, obscene or menacing character, blasphemous or defamatory of any person, in breach of confidence, intellectual property rights, privacy rights or any other third-party rights; (b) to furnish false data including but not limited to false names, addresses and contact details; (c) to send unsolicited mail messages, "junk mail" or other advertising material or malicious email; (d) to intercept or attempt to intercept any communications transmitted over the App; (e) to circumvent or attempt to circumvent any security of the App; (f) to access data not intended for it, or to log on to a network, server or an account that it is not expressly authorised to access or to log on; (g) to upload or distribute viruses or other forms of malware or spyware; or (h) in any manner that (i) negatively affects the use or the functioning of the App; (ii) is not in accordance with applicable laws and regulations; (iii) is or may be disadvantageous, harmful, offensive or in any way wrongful to Timetravelr., other users of the App or third parties; and/or (iv) otherwise causes annoyance or inconvenience.

Timetravelr. has the right to block the use of the App in case of violation by you of any of the terms and conditions of these Terms of Use.

The App is intended for use in the public space. When using the App, you need to be careful and you shall always be aware of the surroundings and any hazards in the area, including traffic, and shall not cause any unnecessary disturbance.

Your use of the App and any actions made following your use thereof are for your own account and risk.

5. Permission and processing of non-personal data

When using the App, usage data, GPS data and motion data from the compass and gyroscope of your device will be collected and processed by the App.

To ensure the App works properly, you will furthermore be requested to allow the App to access the camera on your device and your location data and to collect and process the data therefrom. You can withdraw such access at any time but that will limit the features of the App and your usage of the App.

Data processed during your use of the App will be collected on the basis of the Device-ID in an anonymised form and analysed by Timetravelr. in aggregate form only for optimizing and improving quality, user experience, performance and functionality of the App and building new functionalities. If the Device-ID is registered to your user account, Timetravelr. will anonymize such data in such a way that it is impossible to retrieve the source thereof and does not relate to you or your device and that you are not or no longer identifiable.

6. Monitoring and fair use

Timetravelr. may track your use of various features of the App and Timetravelr. may impose restrictions on your use of certain features (or parts thereof) of the App based on your usage. You will be informed of this via notifications within the App.

Timetravelr. provides access to the App and certain features of the App on the basis of "fair use", which means that in principle Timetravelr. does not impose any restrictions on the usage thereof. However, Timetravelr. monitors your actual usage of such features on the basis of the Device-ID in an anonymised form and compares your usage with the usages of other users. If the monitoring reveals any usage of such features exceeding twice the average usage by other users, Timetravelr. is entitled to suspend, limit or block access to and use of the App.

7. User content

All copyrights and all other intellectual property regarding any photos, text notes or other information or materials of any kind uploaded by you in your personal profile when using the App (User Content) will remain yours. You may remove your User Content at any time from your personal profile.

You hereby grant Timetravelr. a perpetual, royalty-free, worldwide, non-exclusive, irrevocable, transferable license to copy, reproduce, modify, translate, transmit, merge, transfer, share, or otherwise use or make available the User Content for further use within the App by other users and to optimize and improve quality, user experience, performance and functionality of the App.

You hereby represent and warrant that (a) any User Content provided is correct, legal and does not infringe any rights of third parties (b) you have the right to post, upload, send or license such User Content and (c) the User Content does not infringe or violate any third-party rights.

Timetravelr. is not liable for any damage whatsoever, direct and/or indirect, in any way arising from and/or resulting from or relating to any User Content.

8. User community

The App allows users to connect with one another. To do this, you must set your profile to be visible and searchable by other users. You will then be able to send and receive invitations. Sending and receiving invitations is your own responsibility. Timetravelr. is not involved in this process and suggests that you only send invitations to, or accept invitations from, people you know.

In the App, you can accept, decline or withdraw invitations, and manage your connections, including removing a connection.

Once another user has accepted your invitation, or once you have accepted an invitation from another user, you will be connected and you can follow each other via the App, share information, send messages, exchange experiences, tag each other, like each other's posts, and so on.

Timetravelr. may monitor or review any User Content shared with other users as well as the substance thereof and Timetravelr. reserves the right to verify, modify or delete such User Content, when deemed necessary by Timetravelr. or following a notice of another user or a third party.

9. Intellectual property rights

All intellectual property rights, including, but not limited to, copyrights, patents, trademarks, trade name rights, database rights and design rights relating to the App (including all text, logos, graphics, illustrations, photo's, video's, narratives and software) shall remain wholly vested in Timetravelr., or its licensors, are expressly reserved and are not transferred pursuant to these Terms of Use.

You may download the generally accessible information intended for it. If information from the App is distributed, the source of information, including the name of Timetravelr., must be clearly stated and you are obliged not to change or remove the indications that the intellectual property rights belong to Timetravelr. or other references to Timetravelr.

If the use of the App is prohibited because (the use of) the App infringes the intellectual property or other rights of a third party, Timetravelr. shall, at its option, (a) replace (the relevant part of) the App with equivalent services, which does not infringe third party rights; (b) acquire a right of use for (the relevant part of) the App; or (c) cease offering (the relevant part of) the App.

Timetravelr. shall have no liability for any claim of infringement of any intellectual property rights that is based on: (i) any use of the App by you or a third party not in accordance with these Terms of Use (ii) any modification of the App made by you or a third party on your behalf.

Any other or further liability of Timetravelr. regarding the infringement of third-party intellectual property rights is explicitly excluded.

10. Updates

Timetravelr. may from time to time in its sole discretion develop and automatically provide App updates, which may include upgrades, bug fixes, patches and other error corrections and/or new features (Updates). Updates may also modify or delete in their entirety certain features and functionality. You agree that Timetravelr. has no obligation to provide any Updates or to continue to provide or enable any particular features or functionality.

11. Third party content / hyperlinks

The App may display, include or make available third-party content (including data, information, materials and/or other websites and/or servers which are not managed by Timetravelr.) (Third Party Content). You acknowledge and agree that Timetravelr. is not responsible for Third Party Content, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. Timetravelr. does not assume and will not have any liability or responsibility to you or any other person or entity for any Third-Party Content. Third Party Content and/or links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties' terms and conditions.

The App may contain links to other websites and/or third-party materials that are not operated/provided by Timetravelr. This does not mean that Timetravelr. is affiliated with those other websites and/or responsible for its third-party materials, including their accuracy, completeness, quality or any other aspect thereof. Timetravelr. assumes no liability or responsibility for the content of such third-party websites and/or materials. Links to third party websites and/or materials are provided for informational purposes only and access to and use of such third-party websites and/or materials is subject to the terms and conditions of such third party.

12. Processing of personal data

The personal data you provide to Timetravelr. when using the App will be treated confidentially by Timetravelr. in accordance with Timetravelr.'s privacy statement which can be found at: our privacy statement

13. Confidential information

You shall keep confidential any information you may access through the App or otherwise receive from or on behalf of Timetravelr. when using the App which is proprietary, marked as confidential or would normally be considered confidential under the circumstances (Confidential Information) and not disclose the Confidential Information.

Confidential Information does not include information that: (a) has become publicly known through no breach of any obligations of confidentiality; (b) has been independently developed without access to the Confidential Information; (c) is received by you from a third party who has the lawful right to disclose such information; or (d) required to be disclosed by law or by a governmental authority.

14. Disclaimer of warranties

The App uses, among other things, AI-generated content based on photos, videos and drawings. The content in the app is therefore intended to give a general impression and may not (always) be historically accurate or correctly positioned at the correct location.

Although reasonable care has been taken to ensure the accuracy of the App, Timetravelr. provides the App "as is" with standard functionalities and with all faults and defects and without warranty of any kind. Furthermore, Timetravelr. does not guarantee that such faults and defects can be remedied or deleted. Timetravelr. makes every effort to make the App available as much as possible but does not guarantee that the App will always be available or that the App will operate without interruption or failures or that all interruptions or failures will be repaired. Timetravelr. expressly reserves the right to interrupt and/or limit the availability, functionality and/or use of the App at any time for maintenance, security or other reasons.

To the maximum extent permitted under applicable law, Timetravelr., on its own behalf and on behalf of its licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice.

15. Limitation of liability

Timetravelr. is not liable for any damage whatsoever, direct and/or indirect, in any way arising from and/or resulting from or relating to (a) your careless use of the App, (b) your use of the App in breach of these Terms of Use, or (c) the unavailability (temporary or otherwise) of the App and/or the fact that certain information on the App is incorrect, incomplete or not up to date.

In no event will Timetravelr. or its affiliates, or any of its or their respective licensors or service providers, have any liability for any loss or damages arising from or related to your use of or inability to use the App, except for (a) loss or damages that have been caused by wilful intent or gross negligence by Timetravelr. and (b) any damages that cannot be limited or excluded under applicable laws and regulations.

16. Indemnification

You agree to indemnify, defend and hold harmless Timetravelr. and its officers, directors, employees, agents, affiliates, successors and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to (a) your use or misuse of the App or (b) your breach of these Terms of Use.

17. Term and termination

The term of Agreement commences when you download and/or install the App and will continue in effect until terminated by you or Timetravelr. as set forth in this clause 17.

You may terminate your use of the App by deleting the App and all copies thereof from your device.

Timetravelr. may terminate your access to and your use of the App at any time without notice if (a) it ceases to support or operate the App, which Timetravelr. may do in its sole discretion; or (b) you violate any of the terms and conditions of these Terms of Use.

Upon termination (a) all rights granted to you under these Terms of Use will also terminate; and (b) you must cease all use of the App and delete all copies of the App from your device.

Termination will not limit any of Timetravelr.'s rights or remedies under these Terms of Use or at law.

18. Applicable law and dispute resolution

These Terms of Use and any dispute arising or related thereto shall be governed exclusively by Dutch law to the exclusion of rules of private international law regarding the applicable law.

All disputes that may arise in connection with these Terms of Use shall be submitted exclusively in first instance to the competent court of the District Court of The Hague.

If one or more of the provisions of these Terms of Use are null and void or destroyed, the remaining provisions of these Terms of Use will remain in force.

Timetravelr. is entitled to engage third parties in the performance of its obligations relating to the App and/or from these Terms of Use. Timetravelr. is entitled to transfer its rights and obligations under these Terms of Use to a third party to which transfer you consent and cooperate in advance.
